Terms of Use : On this page, we present to you the Terms of Use agreement for our services, which is considered an official contract between the two parties in case each party or individual wishes to know their rights and obligations, and we bear the consequences of any terms that apply to us.

Definitions : This document will contain terms and their definitions:

We, the Messages Gateway Information Technology Establishment, Gateway.sa, and www.gateway.sa, the Messages Gateway website, all these terms refer to the first party, which is the Messages Gateway Information Technology Establishment in its qualified legal capacity.

The client, customer, the pronoun of address, you, your, and it refers to the second party, the site user, customer or visitor, as an adult and in full possession of his mental faculties.

The service provider, or mobile network, refers to the local telecommunications company that provides the mobile number owner with network coverage.

Our service, the service, the messages, and it refers to SMS text messages and their requirements.

By subscribing to the Gateway.sa messaging portal, you agree to the terms and conditions contained in this document, acknowledge that you will review it periodically and are aware of all its amendments and updates, and that you have accepted everything it contains and are prepared to bear all responsibilities in this regard.

Your consent means that you will use these services only for lawful purposes, and you will refrain from and be held responsible for sending or transmitting any material through Gateway.sa that would infringe upon or violate the rights of others, restrict, abuse, or prevent the use of this site, or that involves anything unlawful, threatening, abusive, defamatory, libelous, or invasive of the privacy or copyright of others, or that contains obscene language, or that is offensive to Islam or its sacred symbols, or that is offensive to other religions, or that is otherwise unacceptable, or that would encourage the commission of a crime, or that involves an offense that entails legal liability, or that violates any law of the Kingdom of Saudi Arabia.

Submission Requirements :

Based on the regulations of the Communications and Information Technology Commission, the following must be taken into consideration:

First: It is prohibited to send any message to random or sequential numbers or without the consent of their owners to receive the message, otherwise the regulations of the Communications and Information Technology Commission will be applied to you and your account will be suspended immediately without any notice or compensation.

Second: Sending any unsolicited messages to numbers whose users have not authorized sending them text messages is prohibited, and violating accounts will be frozen until it is proven that there is no violation. In the event that any unsolicited messages are proven to have been sent, any penalties approved by the Communications and Information Technology Commission in the Kingdom of Saudi Arabia will be applied. Third: In the event that any message is sent in violation and is stopped by the operators because it contains obscene language, an advertising format, an invitation to contact suspicious numbers, a recommendation, or any text that is considered to be in violation of the laws of the Communications and Information Technology Commission in the Kingdom of Saudi Arabia, the message will be stopped and its owner will not be compensated, and the evaluation of the validity of the message content will be limited to the operators’ message filtering system.

Fourth: The symbol AD ​​or -AD must be added to the names of promotional senders, and the messaging gateway is not responsible for the message not being delivered because you are aware that promotional messages are subject to operator filters and the DND service for blocking the receipt of promotional internet messages by recipients.

Fifth:

Classification of Messages

(a) Warning Messages: These are high-priority messages with warning content sent to all users in all or some regions of the Kingdom, by specialized government agencies.

(b) Awareness Messages: Messages with awareness or guidance content sent to the general public (or specific categories of them) by entities with a legal status such as governmental or semi-governmental bodies, banks, hospitals, schools, universities, etc., provided that these messages are not used for promotion or aim for profit in a direct or indirect way, and that donations are not collected through them or used to remind people of them.

(c) Personal Messages: Messages sent from a specific user number to another specific number and do not have commercial or marketing content.

(d) Promotional Messages: Messages of a marketing or commercial nature, or for fundraising or reminders.

(e) Service Messages: Messages with service content sent to a specific user for the purpose of providing a personal or automated notification, such as hospital appointments or banking transactions, or for the purpose of electronic verification to confirm his possession of the mobile number.

Sixth:

Procedures for handling different types of messages

1- In type (C) of message classification, the sender’s name ( Tag Name ) must contain the suffix Ad after the name of the sending entity to indicate the nature of its advertising content.

2- Sending messages of type (B) and (C) is prohibited from 10 PM until 7 AM.

Seventh:

Gateway.sa is not responsible for message delays or loss in the following cases

1- Writing mobile phone numbers incorrectly.

2- The lack of text messaging service, the language used, or incompatibility on the recipient's mobile phone.

3- Lack of coverage from the receiving mobile network.

4- A malfunction in the operating system of the receiving mobile phone.

5- The client's device is not valid or does not support receiving outgoing SMS messages from the internet.

6- The device's memory is full and it is unable to receive the message.

7- Blocking the sender's name or the lack of support for this service by the receiving mobile operator.

8- Any other reason outside the scope of the Gateway.sa messaging gateway and related to the client's network or the receiving device.

Eighth:

Registering the sender’s name requires a letter of no objection with an explanation of examples of the content of the messages that will be sent. Registration takes place in a period of no less than two working days and no more than 10 days. If the period exceeds that, the messaging gateway does not bear any responsibility for any delay caused by a third party, the operators.

General Provisions :

1. This website and all its contents are owned by Gateway Information Technology Establishment www.gateway.sa and registered with the Ministry of Commerce under Commercial Registration No. 4030268491. No person or entity has the right to use the website's contents or materials, including logos, designs, audio materials, images, videos, and text content, without written approval from the establishment's management in an official capacity.

2. Anyone who attempts to tamper with the contents of this website will be prosecuted according to the Anti-Cybercrime Law issued by the Communications and Information Technology Commission in the Kingdom of Saudi Arabia and what is stipulated in the regulations ( click here to view the regulations ).

3. The customer has the right to request a refund within a maximum period of 60 days from the date of purchase in the event of poor service, non-provision of service, or internal errors and problems. If the customer requests cancellation of the service and a refund for the messages, we will refund the remaining amount to him (after deducting the value of the points he spent, as well as any bank commission for international transfers, as the transfer will be to the same account number from which the transfer was made). Refunds will not be issued due to errors or problems caused by operators or the involvement of a third party.

4. The Gateway.sa messaging portal has the right to suspend the account of any user who refuses or fails to pay the required dues, as proven by the shipping order record, contracts, technical support tickets, or through recorded calls with account managers, until payment is made. The institution has the right to approach the relevant authorities to claim its rights or authorize whomever it deems appropriate to do so.

5. Due to the difference in international transmission rates from one country to another and from one network to another, the system will automatically deduct the number of points from the balance for the rate of the network to which the message is sent internationally, according to the network rate for each country.

6. When you wish to request a refund, an official letter should be sent to the Message Gateway Information Technology Foundation requesting a refund. The value of the remaining points will be refunded at the same purchase price unless they have expired. The refund will be processed using the same method of collection, whether cash, transfer, or check.

7. The responsibility for the content of the messages sent lies with the account holders from whom they originated, and the Gateway.sa messaging portal bears no responsibility whatsoever for this.

8. All data and messages are treated with the utmost privacy and confidentiality, and all transactions and correspondence are conducted through the forms and applications available on the site.

9. Prices are subject to change from time to time, and the messaging portal has the right to change prices at any time.

10. All customers are bound by the validity periods for all accounts, where the validity period is one year from the date of the last shipment, and the messaging gateway Gateway.sa is not responsible for unused points after their expiry.

11. Gateway.sa and its employees shall not bear any judicial, legal, penal, moral, or ethical responsibility, nor shall they provide any other compensation to users who misuse our services. Gateway.sa or its representative has the right to claim appropriate compensation from users for any material or moral damage that may be reflected on the site.

12. Violating any of the above clauses will result in the account being closed without any compensation being provided to the user or the value of the remaining points in his account being returned.

13. The user is fully responsible for maintaining the privacy and confidentiality of his passwords and personal data and is responsible for all actions taken by others using his account. The user should be careful about the information he discloses and prefers to change his account password from time to time.

14. Gateway.sa respects the privacy of all data contained within each account, regardless of the type of account or which entity it belongs to, and we do not sell it or provide it to any entity except under an official request from the security or judicial authorities.

15. The user agrees to use the system without harming others, engaging in fraud, manipulation, or impersonating any individual, entity, or governmental or private institution. Anyone impersonating an individual or company will be warned and penalized without leniency. Penalties may include account closure and non-refund of any payments made, unless proven otherwise.

16. Gateway.sa accepts no responsibility for any direct or indirect damages incurred by any subscriber as a result of their subscription to the site, whether due to their failure to read or misunderstand this agreement, or their lack of familiarity with its usage. Furthermore, Gateway.sa is not responsible for any errors in message transmission, whether due to errors in data entry by the subscriber or by the contracted parties responsible for sending messages, or for any technical or technological malfunctions beyond the control of Gateway.sa.

17. The above terms and conditions constitute the Service Usage Agreement between the Messages Portal Gateway.sa and all users. The site administration reserves the right to add, cancel, or modify any clause of this agreement or its sections as required by new instructions from the Communications Authority and as required by the site’s interest without prior notice. Therefore, these terms should be reviewed from time to time.

18. Account managers have the right to control the sub-accounts listed under their accounts, which they have personally registered, by adding or withdrawing funds and modifying the data for those sub-accounts. The responsibility for these actions lies with the owner of the primary account under which these sub-accounts are listed. Gateway.sa bears no responsibility in this regard. This does not apply to accounts whose owners have personally registered their accounts on the site and deal directly with the site administration.

19. In the event of a dispute regarding the service, the customer is not entitled to defame or abuse Gateway.sa or its staff in any way. He has the right to arbitration in this case, and if the solution is not satisfactory to both parties, he has the right to resort to the official authorities with jurisdiction only, or to visit our office at the address shown on the About Us page.

20. You are aware of what is stated in the Privacy Policy document and acknowledge that you will follow it periodically. It is a supplement and an integral part of the User Agreement document.
